Terms of Service

Ordery customer agreement

These terms set out the agreement between you and me (trading as Ordery in the United Kingdom) when you create a restaurant workspace or otherwise use the platform. By signing up you confirm that you accept these terms.

1. Definitions

“Ordery” means the online ordering software and related services provided by me as a sole trader. “Restaurant” means the business creating a workspace. “Team member” means any person invited into that workspace. “Storefront” means the web experience presented to your customers for placing orders.

2. Setting up an account

You are responsible for ensuring that the information provided during onboarding is accurate and kept up to date. You must be legally capable of entering into contracts on behalf of the restaurant business.

You control which team members can access Ordery. Please make sure they understand these terms because you are responsible for their actions while using the service.

3. Fees and billing

Subscription fees, transaction fees, and any optional add-ons will be shown during checkout. Payments are processed by Stripe on my behalf. You authorise Stripe to collect charges according to the plan you select. Late or failed payments may result in suspension until the account is brought up to date.

4. Using the service

You agree to use Ordery in line with all applicable laws, including food safety and consumer protection rules. You must not misuse the platform, attempt to gain unauthorised access, or interfere with other workspaces. If you operate delivery, you are solely responsible for arranging couriers and ensuring customer orders are fulfilled.

Customer payment card data never touches Ordery and is handled entirely by Stripe. You must not attempt to circumvent this arrangement or store card details within Ordery.

5. Customer orders and payments

You are responsible for setting accurate menu prices, taxes, and availability, and for communicating clearly with your customers. Ordery provides the tooling to capture orders and pass relevant information to you. Any disputes or refunds with your customers must be handled directly by the restaurant.

6. Data protection

Each restaurant is the controller of customer order data collected through its storefront. I act as a processor for that information, providing hosting and tooling. Please review the Privacy Notice for more detail on how data is handled and the safeguards in place.

7. Availability and support

I aim to keep the service running smoothly and will provide reasonable notice of planned maintenance. From time to time there may be downtime caused by hosting providers or the wider internet. I will use reasonable care and skill but cannot guarantee uninterrupted access.

Support is provided via email and in-app messages during UK business hours unless otherwise agreed in writing.

8. Termination

You may close your workspace at any time through the dashboard. Fees already paid are non-refundable unless stated otherwise. I may suspend or terminate access if you breach these terms, fail to pay amounts due, or if continuing to provide the service would break the law.

9. Liability

I am not liable for any loss of profits, goodwill, or indirect damages. My total liability under these terms is limited to the fees paid by you to Ordery in the twelve months before the issue arose. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Changes to these terms

I may update these terms to reflect improvements to the service, legal requirements, or changes in pricing. I will give you reasonable notice before significant changes take effect. Continued use of Ordery after the effective date means you accept the revised terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales.
